But Rickman still had to pay a $500 penalty to the city Buildings Department as a settlement for allegedly violating the city zoning law when he installed the kitchen stainless sink. The city Buildings Department says when Rickman installed the kitchen sink, that was one of several indications Rickman’s and Witt’s living areas really were separate apartments. That would mean the building had a total of three apartments in an area zoned for two. “Most people don’t have two kitchen sinks in one apartment,” said James Linnan, who prosecutes code violation cases for the city. Rickman settled out of court. He agreed to keep the sink out of the apartment and pay $500 for having put it in in the first place. But Rickman has not given up the fight for the legal right to install the sink. The court action had been delayed while Rickman sought a ruling from the city Zoning Board of Appeals. Rickman had wanted the board either to rule that his living area and Witt’s were only one apartment, or to grant a variance allowing three apartments in the building. Had either of those things happened, it would have legalized the offending sink.single kitchen sink |
